Terms and conditions
1. The Agreement
By making a purchase, you accept our terms of purchase, forming a binding agreement between Knitandnote AS and you as the customer. Please note that the terms of purchase may change, and should be read each time you make a purchase from Knitandnote.
2. The Parties
Seller:
Company Name: Knitandnote AS
Organization Number: 927 152 041
Mailing Address: Øvre Holmegate 1, 4006 Stavanger, Norway
Email: shop@knitandnote.com
Buyer:
The buyer is the consumer who places the order, referred to as the buyer.
3. Price
All prices listed in the online store include VAT. There are no hidden costs, and the price quoted at the time of purchase includes VAT, any invoice fees, and shipping costs unless it is explicitly stated otherwise.
We reserve the right to change prices and correct pricing errors on our products.
Note that offers are valid while stocks last and within the timeframes specified in our marketing. We reserve the right to errors in our inventory. If we are out of stock of an item you ordered, we will ship the available items and credit the missing item(s), or cancel the order if we cannot deliver any of the items. Discount codes always apply to regular-priced items and not to items already on sale. Some discount codes are personal, and we reserve the right to reject sales and deactivate discount codes if misuse is suspected. Only one discount code is allowed per order.
For special offers that require a certain condition to receive a free item, these conditions must be maintained. If you return items that result in not meeting the condition, we will charge you the regular value of the product.
Premium users of Knitandnote receive exclusive premium prices, which are already discounted prices included as part of their subscription. If a buyer with premium prices uses a discount code, it will apply to the regular price since the premium price is already discounted.
4. Products
We offer a range of products from various brands. We try to illustrate images and quality in the online store as accurately as possible, but the images are illustrative and may differ from the actual appearance.
5. Agreement Conclusion
The agreement is binding for both parties when the buyer has submitted their order to the seller. The agreement is not binding if there are typographical or input errors in the seller's offer in the online store ordering system or in the buyer's order, and the other party realized or should have realized that there was such an error. For example, if a product does not have a price.
6. Payment
The seller may require payment for the item from the time it is shipped from the seller to the buyer. If the buyer uses a credit or debit card for payment, the seller can reserve the purchase amount on the card at the time of order. The card will be charged the same day the item is shipped.
When paying by invoice, the invoice is issued to the buyer upon shipment of the item. The payment deadline is stated on the invoice and is at least 14 days from receipt. Buyers under 18 cannot pay by invoice or installment. For more information on payment terms, see the "Payment and shipping" page.
7. Shipping Methods
We currently offer delivery through DHL Express for all shipments outside of Norway. For more details on prices and delivery times, see the "Payment and shipping" page.
8. Risk of the Item
The risk for the item passes to the buyer when the buyer, or the buyer's representative, has received the items delivered according to point 6. The seller is responsible for the item until it is delivered to the buyer.
9. Returns and Right of Withdrawal
You have a 14-day right of withdrawal for online purchases from Knitandnote. To get a refund using the right of withdrawal, you must use the withdrawal form or email us to returns@knitandnote.com with the same information, and return the item in the same condition as when you received it. This means in original packaging, with all tags attached, without smell, marks, or pet hair. The buyer is responsible for paying shipping costs when using the right of withdrawal.
Items must always be packed in suitable shipping packaging so that the original packaging of the product is not damaged. If the original packaging is damaged or removed, the item will be considered used.
If you cancel the entire purchase, you will be refunded the value of the items at the time of purchase within 14 days after we have processed your return. You will receive an email when your return is processed (normally 1-3 weeks after it is submitted). If you paid by card, the amount will be refunded directly to the same card you used at purchase.
It is your responsibility as a customer to ensure the package reaches us. Therefore, consider whether you want to send the package with or without tracking.
If you need to return all or part of your order and chose invoice as the payment method, you can extend the due date for free at www.klarna.no. If not done, a late fee may be charged before your return is received and processed. Late fees are charged to the customer. Klarna can be contacted at 21 01 89 91 or www.klarna.com/no/kundeservice.
The invoice is updated as soon as we have processed your return. If you have already paid your invoice, Klarna will contact you to get your account number for the refund. If there are discrepancies with returned items on your invoice/payment, contact us immediately so we can investigate the matter/trace the items.
If you notice any discrepancies with returned goods on your invoice/payment, you must contact us immediately, so that we have the opportunity to investigate the matter/trace the goods.
For returns and refunds of items purchased with a gift card along with another payment method, you will first be refunded the amount paid directly, and the remaining amount will be added to the gift card used. If only a gift card was used to pay for the order, the gift card will be reloaded with the return value.
Note that the right of withdrawal only applies to physical products. Purchases of digital products or services, such as subscriptions to Knit&Note, do not have a right of withdrawal.
10. Order Cancellation/Changes
We do everything we can to pack and ship your order as quickly as possible. We use a robot system in the warehouse, making it normally impossible to cancel a purchase or make changes after the order is completed.
11. Delivery and Delay
We do our best to deliver as quickly as possible at all times. The delivery time is normally 1-7 business days, but there may be cases where it takes longer.
In cases of different batch numbers, inventory errors, etc., delays may occur that may affect delivery time. All delivery times provided by us should be considered indicative. We also note the possibility of delays during periods of high demand, both with us and our partners.
If your order has not been delivered within 3 weeks, you have the right to cancel the purchase at no cost, unless otherwise agreed. If you have not received your package within 5 weeks, you are responsible for notifying us within 5 weeks after your order. Your order will be considered delivered after this time.
We always ship all items together in the same package. If you have received your package but are missing parts of your order, you are obligated to notify us immediately after receiving the package. If we do not receive notification, your entire order will be considered received. If you receive an SMS that the package is delivered to your mailbox/door and the package is not there, it is important to contact us immediately so we can trace the package. If we have packed the wrong item, it is important to notify us within 14 days after receiving the item. The received products must then be returned unused in original packaging, but we will pay the return cost and send the correct item if it is still in stock. We reserve the right to out-of-stock situations.
12. Complaints about Defects and Time Limit for Claims
If there is a defect with the item, you have a 2-year complaint right from when you received the item. This assumes that you notify us within a reasonable time, a maximum of 2 months after the defect was discovered or should have been discovered.
We recommend contacting us immediately to document the problem with the item. We require close-up pictures and an overview image of the item's defects. If something is damaged/marked/stained/smells on the product when you receive the package from us, contact us immediately to inform us. Note that if the item is used excessively or not for its intended use, the 2-year complaint right is void. It is important to have the receipt/order number for your purchase.
For complaints, you will receive a new item if we still have the product in stock, otherwise, you will be refunded the same amount for the complaint item(s) as when it was purchased.
Just as it is our responsibility to ensure the package reaches you, it is your responsibility to ensure the package reaches us.
Complaint items must be returned to us within a reasonable time, no later than 14 days after you have received complaint approval via email from us.
13. Seller's Rights in Case of Buyer's Default
If the buyer does not pay or fulfill the other obligations under the agreement, and this is not due to the seller or circumstances on the seller's side, the seller may withhold the item, demand fulfillment of the agreement, demand the agreement be canceled, and claim compensation from the buyer. The seller may also, in some cases, charge interest for late payment, collection fees, and fees for uncollected items not paid in advance.
Fee for Uncollected Items:
If the buyer fails to collect ordered items, the seller may charge the buyer a fee, i.e., return and handling costs (NOK 199,-) as well as accrued interest and fees for invoice purchases. The fee shall cover the seller's actual expenses for delivering the item to the buyer. Such a fee cannot be charged to buyers under 18 years of age.
14. Warranty
Any warranty given by the seller or manufacturer gives the buyer rights in addition to those the buyer already has under mandatory law. A warranty thus does not limit the buyer's right to make complaints and claims in case of delays or defects under sections 9 and 10.
15. Personal Data
Personal data will not be disclosed to any third parties but will only be used to fulfill the agreement with the buyer. See also Knit&Note Privacy and Terms of Service for a complete overview.
16. Dispute Resolution
Complaints should be addressed to the seller within a reasonable time, cf. sections 9 and 10. The parties should try to resolve any disputes amicably. If this does not succeed, the buyer can contact the Norwegian Consumer Council for mediation.
